1. Who We Are and Scope
This Privacy Policy describes how The James Sanson Team at Real Broker LLC ("we," "us," "our," or the "Operator"), the operator of MaricopaNewHomes.com (the "Site"), collects, uses, shares, retains, and protects personal information. The Operator is James Sanson, a licensed Arizona REALTOR. The employing broker is Real Broker LLC. The state of licensure is Arizona, regulated by the Arizona Department of Real Estate (ADRE), azre.gov. The privacy contact is sales@maricopahomesforsale.com, phone 520-838-8037. This Policy applies to information collected through the Site, its forms, and phone, text, and email communications with our team, and through inquiries routed to our affiliated intake as described in Section 7. It does not apply to third-party websites or builder sites linked from the Site. This Policy is incorporated into our Terms of Service by reference; by using the Site, you agree to both.
2. Notice at Collection
Consistent with the California Consumer Privacy Act and similar state laws, this section is the notice we provide at or before the point of collection. We collect identifiers (name, phone, email, and any address or community of interest you provide), commercial information (your home-search interest), internet and device activity (page views, IP address, analytics data), general geolocation (IP-based), advertising identifiers, and inferences drawn from the foregoing. We collect this to respond to your inquiry, help you explore new-construction options, operate and improve the Site, advertise our services, and meet our legal obligations. We do not sell your personal information for money. Because we use analytics and advertising technologies, certain state laws may treat some data uses as "sharing" for cross-context advertising; you can opt out as described in Sections 10 and 13. Retention is in Section 17; your rights are in Sections 22 through 28.
3. Categories of Personal Information We Collect
Identifiers: name, telephone number, email address, address or community of interest (if provided), IP address, and online and device identifiers, including advertising identifiers and cookie IDs.
Customer records: information you provide in forms or messages about the homes, communities, or builders you are interested in and your buying goals.
Commercial information: your new-construction interests, the communities or floor plans you inquire about, and our communications about them.
Internet or network activity: pages you view, time on page, links clicked, referring page, search terms where available, browser, operating system, and device type, collected in part through analytics and advertising tools.
Geolocation: non-precise, IP-based location (typically city or region). We do not collect GPS-level location through the Site unless you provide a specific property address.
Inferences: conclusions we or our advertising tools may draw to characterize your interests for measurement and advertising.
What we do not collect through the Site: Social Security numbers, driver's license numbers, financial account or payment card numbers, login credentials, biometric or genetic data, or health information. Please do not submit those through a web form.
4. How We Collect Personal Information
Directly from you: when you submit a form, call, text, or email us, or otherwise communicate with us.
Automatically: when you visit the Site, our systems and our analytics and advertising providers collect IP address, browser and device data, pages visited, timestamps, the referring page, and similar technical information through cookies, pixels, and similar technologies, as described in Section 12.
From third parties: if you reach the Site through a search engine, advertising platform, or referral, that party may share limited attribution information with us, such as the campaign or search terms. We do not purchase personal information about you from data brokers.
5. How We Use Personal Information
We use personal information to respond to your inquiry; to help you explore and compare new-construction communities and floor plans; to connect you with a builder's sales office when you ask us to; to provide real estate brokerage services if you engage us; to maintain transaction and business records as required by Arizona Administrative Code R4-28-802 and other law; to operate, secure, and improve the Site; to measure and deliver advertising for our services; to prevent fraud and protect security; to enforce our agreements; and, with your consent, to send you marketing communications by email or SMS. We do not use personal information for materially different purposes without updating this Policy and, where required, obtaining your consent.
6. Sensitive Personal Information
"Sensitive personal information" is a defined category under the California Privacy Rights Act and several other state laws. We do not affirmatively collect sensitive personal information through the Site, and we do not request Social Security numbers, financial account numbers, login credentials, precise geolocation, or information about race, religion, health, genetics, biometrics, or sexual orientation through any Site form. If you choose to include such information in a message, we treat it with extra care and use it only to respond to your inquiry and maintain our records. California and certain other state residents may request that we limit the use and disclosure of sensitive personal information; see Section 26.
7. New Construction, Builders, and Buyer Representation
Because this Site focuses on new-construction homes, this section describes how we handle the information central to that service. James Sanson is a licensed Arizona REALTOR who represents you, the buyer. When you ask us to connect you with a builder or a builder's sales office about a community or floor plan, we share the contact and interest details needed to make that introduction. Builders and their sales offices are independent third parties with their own privacy practices, and information you provide to them directly is governed by their policies, not this one. We recommend having your own buyer representation when purchasing new construction; a builder's sales agent represents the builder. We do not promise any specific home, price, incentive, lot, or completion date; those are set by the builder and are subject to change.
8. Children and Minors
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in violation of the federal Children's Online Privacy Protection Act. Several states impose additional protections for minors aged 13 to 18; we do not target the Site to minors or knowingly collect their information for advertising or profiling. If you believe a minor has provided information to us, contact sales@maricopahomesforsale.com and we will delete it. Real estate transactions sometimes involve minor heirs or beneficiaries; information about minors in that context is handled under applicable real estate, trust, and probate law.
9. Mobile and Text Message Information
Text messaging is opt-in. You consent by checking the box on our form before you submit, agreeing that we may contact you by phone, text, and email, including by automated means. Consent to messaging is not a condition of buying a home. Message and data rates may apply, and message frequency varies. You may opt out of texts at any time by replying STOP, and reply HELP for help.
We do not share or sell mobile phone numbers, SMS opt-in data, or text-message consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with the service providers that help us deliver messages to you. This SMS-specific protection applies regardless of the advertising and analytics practices described elsewhere in this Policy.
10. Sale, Sharing, and Targeted Advertising
We do not "sell" your personal information for money. However, because we use analytics and advertising technologies such as Google Analytics, Google Ads, and Meta advertising, some state privacy laws may treat the use of advertising cookies and identifiers as a "sale" or as "sharing" for cross-context behavioral advertising or "targeted advertising." To the extent those laws apply, you have the right to opt out.
How to opt out: enable the Global Privacy Control signal in your browser (see Section 13), use the ad-settings and opt-out tools offered by Google (at adssettings.google.com) and Meta (in your account ad preferences), use the Digital Advertising Alliance opt-out at optout.aboutads.info, or manage cookies in your browser. We honor recognized opt-out preference signals. Opting out of advertising cookies does not stop us from contacting you about an inquiry you submitted.
11. Who We Share Personal Information With
We share personal information only as described here, and never by selling it for money. Our team and affiliated intake: we route your inquiry to our affiliated intake at MaricopaRealEstateAgents.com, which receives and routes incoming requests for The James Sanson Team, so your request reaches the right person. Builders, with your request: when you ask us to connect you with a builder or sales office, we share the contact and interest details needed to make that introduction. Service providers: we use providers that process information on our behalf under confidentiality obligations, listed in Section 21. Transaction parties: if you engage us for a transaction, we share with the other party, title and escrow, lenders (with your authorization), and similar parties the information necessary to complete it. Brokerage and regulators: we share with Real Broker LLC and with ADRE, NAR, and AAR as required by law or brokerage policy. Legal and protection: we share when required by law or to protect rights, property, or safety. Business transitions: in a merger, acquisition, financing, or sale of assets, information may be transferred with notice and choices where required. With your consent: for example, to make a referral you request.
12. Cookies, Analytics, Pixels, and Tracking
The Site uses cookies and similar technologies, including for analytics and advertising. Strictly necessary cookies support basic Site functionality and cannot be disabled. Analytics: we use Google Analytics and may use similar tools to understand how the Site is used so we can improve it. Advertising and remarketing: we use Google Ads and may use Meta and other advertising platforms to measure performance and show our ads to past visitors across other sites and apps. These platforms set cookies or use identifiers in accordance with their own privacy policies. Controlling cookies: most browsers let you view, manage, delete, and block cookies, and you can use the ad opt-outs in Section 10 and the Global Privacy Control in Section 13. Disabling cookies may affect some Site features.
13. Global Privacy Control and Opt-Out Signals
Several state laws require businesses to honor opt-out preference signals such as the Global Privacy Control (GPC). We honor GPC signals from all visitors. When you visit the Site with GPC enabled, we treat it as a request to opt out of any sale or sharing of your personal information for cross-context behavioral advertising, and we configure our advertising tools accordingly. You can enable GPC through a supporting browser or extension; more information is at globalprivacycontrol.org. For these signals to take effect, they must be sent by your browser before our advertising tools load.
14. Lead Source and Consent Records
We maintain records of the source of each inquiry and of the consent you provide when you submit a form, including the consent language shown, the date and time, and the contact details you entered. When an inquiry is routed to our affiliated intake, the consent record travels with it. We keep these records in our own systems to document consent consistent with the Telephone Consumer Protection Act and applicable law. If we add a third-party consent-verification platform in the future, we will update this Policy.
15. Call Recording and Voice Data
Arizona is a one-party-consent state for recording telephone conversations (A.R.S. 13-3005). If a call between you and us is recorded, the recording is treated as personal information under this Policy, is used only for the purposes in Section 5, is accessible only to authorized team members, and is retained consistent with Section 17. We do not use voice biometric identification or voice recordings to train AI models. Our primary number, 520-838-8037, is a voice line that does not receive text messages.
16. Artificial Intelligence and Automated Processing
We may use limited artificial intelligence and automated tools in our operations, such as organizing inquiries, routing them to the right team member, or drafting communications. We do not use these tools to make final decisions that produce legal or similarly significant effects on you. You may request information about whether automated processing was used in connection with your inquiry, and you may request human review of any automated result, by contacting sales@maricopahomesforsale.com. We use AI providers only under terms that limit the use of input data to providing the service to us, and we do not authorize them to train their models on your personal information where the provider supports that configuration.
17. Data Retention
We retain personal information for as long as needed for the purpose collected. Inquiry communications are retained for at least five years to maintain a record consistent with Arizona Administrative Code R4-28-802. Transaction records in which you become a client are retained for the period required by R4-28-802 (typically five years from closing or termination) and any longer period required by tax law or our insurer. Email and SMS consent records are retained for at least four years, consistent with the TCPA. Analytics and advertising data are retained per the tools' retention settings. Some information must be retained even after a deletion request to meet legal and record-keeping obligations.
18. Data Security
We use reasonable administrative and technical safeguards, including HTTPS encryption of Site traffic, password-protected administrative access, need-to-know internal access limits, secured transmission of inquiries to our affiliated intake, reputable service providers, and secure deletion when information is no longer needed and not subject to retention. No method of transmission or storage is completely secure, so we cannot promise absolute security. If you become aware of a security concern, contact sales@maricopahomesforsale.com immediately.
19. Data Breach Notification
If we experience a breach affecting your personal information, we will notify you as required by applicable law. Arizona's breach notification law, A.R.S. 18-552, requires notice to affected Arizona residents within forty-five days of discovery of a breach of unencrypted personal information, and we comply with Arizona's requirements and those of other states whose residents are affected. Notice will describe the breach, the information involved, the steps we are taking, and the steps you can take, and will be provided by email, phone, or posting on the Site as appropriate.
20. Cross-Border Data Transfers
We are based in the United States and process information here. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, which may have different data protection laws than those in your country. For residents of the EU, UK, or Switzerland, we rely on recognized transfer mechanisms, such as Standard Contractual Clauses, where required.
21. Service Providers and Sub-Processors
We engage the following service providers, who process personal information only to provide services to us:
- Hostinger — website hosting and Site traffic.
- SendGrid (a Twilio company) — transactional email delivery of inquiries to our team.
- Twilio — SMS notification delivery to our team.
- FreedomVoice — inbound voice calls to 520-838-8037.
- Google — analytics and advertising.
- Meta — advertising and remarketing.
- MaricopaRealEstateAgents.com — our affiliated intake, which receives and routes inquiries for the team.
This list is current as of the date above and may change as our tools change. If we add a customer relationship management or marketing-automation platform in the future, for example to support drip email, IDX buyer alerts, or seller home-value reports, we will update this list and, where required, this Policy before that tool processes your personal information. Where state law requires, we maintain data processing agreements with providers that handle the personal information of residents of those states.
22. Your Privacy Rights: California (CCPA/CPRA)
If you are a California resident, you have the right to know what personal information we collect and how we use and share it; to request deletion, subject to exceptions including the ADRE record-retention requirement; to correct inaccurate information; to opt out of the sale or sharing of personal information for cross-context advertising (see Section 10); to limit the use of sensitive personal information; to data portability; and to non-discrimination for exercising these rights. To exercise them, see Section 26.
23. Your Privacy Rights: Other US States
Residents of states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Jersey, New Hampshire, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and Nebraska, generally have rights to confirm, access, correct, delete, and obtain a portable copy of their personal data; to opt out of the sale of personal data, targeted advertising, and certain profiling; and to appeal a denial. Exemptions may apply, including the Arizona real estate record-retention requirement. To exercise these rights, see Section 26.
24. Your Privacy Rights: EU, UK, Switzerland, and Canada
If you are located in the EU, UK, or Switzerland, you may have rights under the GDPR, UK GDPR, and Swiss FADP, including the rights to be informed, to access, to rectification, to erasure, to restrict or object to processing, to data portability, to withdraw consent, and to lodge a complaint with a supervisory authority. Where the GDPR applies, we process information based on your consent, the performance of a contract or pre-contract steps, our legal obligations, and our legitimate interests. Residents of Canada may have rights under PIPEDA and provincial laws, including access, correction, and withdrawal of consent. To exercise these rights, see Section 26.
25. CAN-SPAM and Email Choices
We comply with the federal CAN-SPAM Act for commercial email. Every marketing email includes an unsubscribe link, and you may also email sales@maricopahomesforsale.com to be removed from marketing correspondence. We will promptly honor opt-out requests. We may still contact you about an active inquiry or transaction after you opt out of marketing.
26. How to Exercise Your Rights
To exercise any privacy right, email sales@maricopahomesforsale.com with the subject line "Privacy Request" and a description of your request, or call 520-838-8037. Please include your name, the contact information you previously provided, and the right you are exercising. We will acknowledge your request within ten business days and respond substantively within forty-five days, with one possible forty-five-day extension where reasonably necessary; GDPR responses are provided within thirty days. We do not charge a fee unless a request is excessive, repetitive, or unfounded. Before fulfilling a request to access, delete, or correct information, we verify your identity by matching the contact details we hold, and we use the verification information only to process your request.
27. Authorized Agents and Appeals
You may designate an authorized agent to make a request on your behalf by providing signed permission and verifying your identity with us; we may require evidence of the agent's authority. If we decline to act on your request, you may appeal within sixty days by emailing sales@maricopahomesforsale.com with the subject line "Privacy Appeal," and we will respond within sixty days. If you are not satisfied, you may contact your state attorney general or applicable regulator.
28. Non-Discrimination
We will not discriminate against you for exercising any privacy right, including by denying services, charging different prices, or providing a different level or quality of service. We do not currently offer financial incentives in exchange for personal information.
29. Third-Party Links
The Site may link to third-party websites, such as builder sites, listing portals, lender pages, or community pages. We are not responsible for the privacy practices of those sites. Review their privacy policies separately.
30. Changes to This Policy
We may update this Policy to reflect changes in our practices or the law. When we do, we will update the "Last updated" date. For material changes affecting your rights or choices, we will provide additional notice through the Site or by email, where we have an email address on file, at least 30 days before the change takes effect, except where a shorter period is required by law. Your continued use of the Site after the effective date constitutes acceptance.
